Seeking Medical Treatment and Lost Wages
Unlike similar personal injury circumstances, accidents that occur in the workplace are covered by Oklahoma's workers' compensation law, which resembles an insurance program for workers.
If you've been injured on the job, you are entitled to medical treatment. If you cannot work, you are entitled to partial lost wages.
It does not matter who was at fault for your accident. If you report a workplace injury, your employer should provide you with a doctor to assess and treat that injury. If your employer does not send you to a doctor within three days, you have a right to choose your own doctor.
If your workers' compensation doctor says that you cannot go back to work, you are entitled to two-thirds of your normal wages. If the doctor says you can only go back to work with certain restrictions, your employer must honor those restrictions. Your employer should also pay for any necessary rehabilitation expenses.
Standing Up for Your Workers' Comp Rights
If your employer is refusing to send you to a doctor after you've reported an injury, telling you that you are not injured or that your injury was not suffered in the workplace, we can help you assert your rights. If your employer's doctor told you that you can return to work, but you believe the doctor is wrong, we can pursue a second medical opinion.
Workers' compensation is a unique area of law, and our attorneys understand how to pursue fair results within the workers' compensation system. Contact us to discuss how we can help you get the support you need to recover from your workplace injuries.
