This protection extends to all employees and all employers except those excluded under the Workers' Compensation Act. Important factors to be considered are the length of employment, the proximity of the firing to the filing of the workers' compensation claim, and the employers 'reputation' for firing all, or mostly all, workers' compensation claimants. Recoverable damages include back wages, future wages and punitive damages for the employer's willful act.
